Terms of Service
Last updated
These terms are the agreement between your company and CallMOR for using CallMOR at app.callmor.ai. By creating an account or using the service you accept them on behalf of your company. “We” means CallMOR; “you” means the company that holds the account and the people it allows to use it.
1. Your account
You must be able to enter into contracts for the business you sign up, and the information you give us — including the business details used to register your texting with carriers — must be accurate and kept up to date.
The person who creates the account becomes its first administrator. Administrators decide who else has access, which services are switched on, and how the account is billed. You are responsible for everyone you invite and for what is done in your account.
Keep sign-in details private, turn on a second factor, and tell us promptly at support@callmor.ai if you believe someone has used your account without permission.
2. The 30-day free trial
A new company gets a free trial that runs for 30 days from signup. During the trial, the following cost nothing and need no payment method:
- Document management (Documents).
- Customer forms.
- Reviews.
- Team chat, which is included with every account and never billed.
- Additional users: no seat fee is charged while the trial runs.
- One local phone number that forwards incoming calls to a cell phone or landline in the 50 states, DC or Canada (not toll-free) of your choice, for an account whose mobile number was verified by a texted code at signup — one per verified mobile number — while we offer it. It cannot send or receive texts, run phone menus or send and receive faxes.
Every other service needs a payment method and is billed from the day it is switched on, including during the trial: texting (SMS and picture messages), the phone system (voice and phone menus), fax, text-to-pay, HIPAA mode and analytics.
We remind you before the trial ends, with a countdown in the app and notifications on days 7, 20, 25 and 28 and on the last day.
We may refuse or end a trial that is being used to avoid paying, for example by opening repeated accounts for the same business.
3. Billing after the trial
If a payment method is on file when the trial ends, the free services you have kept, each active user beyond your first, and the trial phone number if you claimed one start billing from the end of the trial.
Each service has its own monthly price, shown in the app and on our pricing page before you switch it on. Your bill is the sum of the services switched on plus the users beyond your first. Some services include an allowance, such as a number of text message segments; use beyond an allowance is billed after it happens.
Payments are processed by Stripe. We do not store card numbers. You authorise us to charge the payment method on file for fees as they fall due. Prices do not include taxes, which you are responsible for where they apply.
You can switch a service off at any time from Billing. It keeps running to the end of the period already paid for and then stops. If a service is ended early at your request, any unused part of its period may be credited to your next invoice. Fees already paid are otherwise not refunded, except where we agree or the law requires it.
We will give you notice before a price change applies to a service you already have.
4. Suspension
If the trial ends without a payment method on file, the account is suspended. Administrators can still sign in and reach Billing, and adding a payment method restores access. A trial phone number stops forwarding calls when the trial ends; it is kept for 30 days after the trial ends, then released.
We may also suspend an account, or a single service, if fees are unpaid, if the account breaks these terms or the Acceptable Use Policy, if a carrier or regulator requires it, or to protect the service, other customers or the public. Where we reasonably can, we will tell you why and what will lift it.
Suspending an account does not by itself delete its data.
5. Acceptable use
You must follow our Acceptable Use Policy, which forms part of these terms. In short: no spam, no unsolicited texting, no robocalls, and nothing illegal.
6. Texting and calling laws are your responsibility
Your business is the sender of every text and the caller on every call made through your account. You are responsible for complying with the laws and rules that apply to them, including the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, state telemarketing and texting laws, carrier and industry rules, and the 10DLC registration requirements of US carriers.
That means getting and keeping a record of the consent each kind of message requires before you send it, honouring opt-outs straight away, identifying your business, respecting quiet hours and do-not-call rules, and describing your business and messages accurately when you register.
CallMOR's tools — consent records, automatic STOP handling, blocking texts until registration is approved — help, but they do not make your messaging compliant on your behalf. If a carrier or regulator charges a fee or penalty because of messages or calls sent from your account in breach of these rules, you are responsible for it.
7. Your data
The information your company puts into CallMOR — contacts, messages, call records, files, form responses and the rest — belongs to your company. You give us permission to store, process and transmit it only to provide the service to you, to keep it secure, and as the law requires.
We handle personal information as our Privacy Policy describes.
If your business is subject to HIPAA, you may store protected health information in CallMOR only after a Business Associate Agreement is in place between you and CallMOR. HIPAA mode adds stricter retention, redaction and audit controls, but it does not by itself make your use compliant.
You can export your contacts at any time, and each user can export the data held about them. Export what you need before closing your account; after an account is closed its data may be deleted.
8. Other companies' services
Texts, calls and faxes travel over carrier networks; payments go through Stripe; review links point to sites such as Google and Facebook; and you may send form responses to your own systems. Those services have their own terms, and we are not responsible for how they operate.
9. Emergency calls
Do not rely on CallMOR to reach emergency services. Calls to 911 may not connect, or may not pass your location correctly, from the browser phone or the forwarding number. Keep another way to call for help.
10. Changes to the service
We improve CallMOR continually and may add, change or retire features. We will tell you in advance of a change that materially reduces a paid service you use.
11. Disclaimers and limits
CallMOR is provided as is. Carrier networks, the internet and other services outside our control can delay or fail to deliver messages, calls and faxes, and we do not promise that the service will be uninterrupted or error-free.
To the extent the law allows, neither party is liable for indirect, incidental or consequential losses, or lost profits, and our total liability for any claim relating to the service is limited to the fees you paid us in the twelve months before the claim arose.
12. Ending the agreement
You can stop using CallMOR at any time by switching your services off and closing your account. We may end this agreement with notice, or immediately for a serious breach of these terms or the Acceptable Use Policy.
13. Changes to these terms
We may update these terms. The date at the top shows when they last changed, and we will tell you by email or in the app before a material change takes effect. Continuing to use CallMOR after that means you accept the updated terms.
